Terms of Service – Cakes by Thierry

1. Overview

Welcome to Cakes by Thierry.

These Terms of Service govern your use of our website and the purchase of cakes, desserts, pastries and other products through our online store, powered by Shopify.

By accessing our website or placing an order, you agree to these Terms of Service and our applicable store policies.

Nothing in these terms excludes or limits your rights under Australian Consumer Law.

2. Products and Availability

All our cakes and desserts are freshly prepared.

We make every effort to ensure product descriptions, photographs, flavours, sizes and prices are accurate.

As our products are handmade, slight variations in appearance, decoration, colour and finishing may occur.

Product availability may change depending on ingredients, seasonal supply and production capacity.

We reserve the right to discontinue products or adjust future product offerings without notice.

3. Placing an Order

Orders may be placed through our online store.

Customers are responsible for providing accurate information, including:

Full name and contact details
Correct cake selection, size and flavour
Personalised messages or inscriptions
Preferred collection date and time
Any relevant dietary or allergy information

Orders require a minimum of two days' advance notice.

An order is confirmed once payment has been successfully processed and we have accepted the order.

If we are unable to fulfil an order, we will contact the customer to discuss suitable alternatives or provide an appropriate refund.

4. Custom Cake Enquiries

Custom and special occasion cakes may require additional consultation before a final price is confirmed.

Submitting a custom cake enquiry through our website does not constitute a confirmed order.

A custom cake booking is only confirmed once the design, price, collection arrangements and payment requirements have been agreed upon.

Customers should provide accurate information regarding designs, colours, inscriptions, serving requirements and any requested decorations.

We will endeavour to reproduce agreed designs as closely as reasonably possible. However, handmade cakes may differ slightly from reference photographs.

5. Pricing and Payment

All prices displayed on our website are in Australian dollars (AUD).

GST will be included where applicable and indicated in accordance with Australian law.

Full payment is required for standard online cake orders unless otherwise agreed.

Prices may change without notice, but confirmed orders will not be affected by subsequent price changes.

Any additional charges for customisation or modifications will be communicated before acceptance.

6. Collection and Pickup

Cakes by Thierry currently operates on a pickup-only basis.

Collection location: Jimmy's Deli, Yarraville, Victoria, Australia.

Collection days: Tuesday to Sunday.

Collection hours: 10:00 am – 2:00 pm.

Customers must select an available collection date and time when placing their order.

Customers are responsible for arriving during their nominated collection window.

If you are running late or cannot collect your order, please contact us as soon as possible.

We cannot guarantee that perishable products will remain suitable for collection after an extended delay.

7. Order Changes and Cancellations

We understand that circumstances may change.

Requests to modify or cancel orders should be submitted as early as possible.

Cancellations requested more than 48 hours before collection may be eligible for a refund, depending on whether preparation has commenced or non-recoverable costs have been incurred.

Change-of-mind cancellations within 48 hours of collection are generally non-refundable.

Custom cake cancellations will be assessed according to the work completed and costs incurred.

These conditions are subject to Australian Consumer Law and our Returns and Refunds Policy.

8. Food Allergies and Dietary Requirements

Our kitchen handles ingredients that may contain common allergens, including nuts, dairy, eggs, gluten and soy.

Although we take reasonable precautions, cross-contact between allergens may occur.

Customers with allergies, intolerances or specific dietary requirements should contact us before placing an order.

We cannot guarantee that products are completely free from a particular allergen unless expressly confirmed.

Customers must ensure that any dietary requirements are communicated clearly before an order is confirmed.

9. Cake Storage and Transportation

Customers are responsible for transporting and storing their purchases appropriately after collection.

Cakes should be transported on a flat, stable surface and kept at the recommended temperature.

Storage instructions provided by Cakes by Thierry should be followed.

We are not responsible for damage or deterioration resulting solely from improper transportation, handling or storage after collection.

This does not limit any rights under Australian Consumer Law.

10. Refunds and Consumer Guarantees

Due to the perishable nature of our products, change-of-mind returns and exchanges are generally not accepted.

If a product is faulty, damaged, incorrectly supplied or does not meet applicable consumer guarantees, customers may be entitled to a repair, replacement, refund or other remedy under Australian Consumer Law, as applicable.

11. Website Information and Errors

We make reasonable efforts to maintain accurate information on our website.

Occasionally, product descriptions, pricing or availability may contain errors.

Where an error affects an order, we will contact the customer to explain the issue and discuss available options.

If we cannot fulfil an accepted order, we will provide any refund required by law.

12. Intellectual Property

All original website content, including Cakes by Thierry branding, photographs, cake designs, descriptions and other materials, remains the property of Cakes by Thierry or the relevant rights holder.

Content must not be reproduced or used commercially without appropriate permission.

13. Website Use

Customers agree not to misuse our website, submit fraudulent orders, interfere with website security or engage in unlawful activity.

We may restrict access or decline transactions where reasonably necessary to prevent fraud, misuse or unlawful conduct, subject to applicable law.

14. Privacy and Personal Information

We collect and process personal information necessary to manage orders, payments, enquiries and customer communications.

Our online store is powered by Shopify, which processes certain information to provide ecommerce services.

15. Third-Party Services

Our website may use third-party services, including Shopify and payment processors.

These services may be governed by their own terms and privacy policies.

Purchases from Cakes by Thierry are transactions between the customer and the business operating Cakes by Thierry, not Shopify.

16. Limitation of Liability

To the extent permitted by law, Cakes by Thierry is not responsible for losses caused solely by circumstances outside our reasonable control or by improper handling of products after collection.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, remedy or liability that cannot lawfully be excluded under Australian law.
